Dear Sir, / Madam,
In pursuance with the resolutions
adopted in the general body meeting of the Differently Abled Employees Welfare
Association met on 13/7/2014, the Association has been renamed as “ALL INDIA DIFFERENTLY ABLED EMPLOYEES
ASSOCIATION” to address the service problems of the employees working in
all the Government establishments including Central, state Governments,
PSUs/Banks/ Insurance and other allied government offices/establishments in
India, and it is decided to convene a
meeting on 11/10/2014 at New Delhi (Venue will be communicated later) with the
representatives of all the states to form the State Bodies and to decide future
course of Action.
The following is the agenda of the meeting.
1. To
establish a Central Association office at New Delhi.
2. To constitute state bodies and
district bodies in different states and in union territories and districts
respectively. The Central Executive is authorized to nominate the Adhoc Bodies,
which will be in office, till the next elections are held.
3.
To discuss and decide the future course of action
for achieving the implementation of rule of reservation in promotions in all
cadres ie from D,C, B & A groups with retrospective effect from the date of
publication of the PwD Act in the Gazette ie 07/02/1996 in all the Government establishments
including Central, state Governments, PSUs/Banks/ Insurance and other allied
government offices/establishments in India.
4.
To
discuss and decide the further course of action to get the revised PwD Act with
necessary amendments including action against atrocities etc.
5.
To
discuss and decide to support and participate in the movements for the cause of
welfare of the differently abled with sister organizations.
6.
To
adopt a resolution to demand all the amenities to the employees with disabilities.
7.
To
represent for IT exemptions and Old Pension scheme in place of Contributory
Pension Scheme.
8.
Any
other item with the permission of the Chair.
All
the employees with disabilities of all the states and union territories,
working all in the Government establishments including Central, state
Governments, PSUs/Banks/ Insurance and other allied government
offices/establishments in India, are requested to extend their solidarity and
attend the above meeting and extend full co operation in achieving our
legitimate demands.
No TA
& DA will be borne by this Association.
The
Venue for the meeting will be communicated to those, who are interested to
participate in the said meeting.

R D E R:
In the G.O 1st read above,
orders were issued relaxing the ban on transfersup to 30th September,
2014 subject to certain conditions. In the G.O 2nd read above, it
was further instructed that all the Departments shall take adequate care to
fill up the vacancies in Rural and Remote areas on priority, while effecting
transfers.
2. In
pursuance of the requests made in the representation 3rd and 4th
read above, it has been decided that
preference be given in spouse cases, disabled persons/physically challenged
persons, employees having mentally retarded children to effect transfers of
Non-Gazetted officers through counseling etc. It has also been decided to
extend the period of Ban on transfers till 10th October, 2014.
3. Accordingly the following amendments are given to the G.O 1stread
above:
AMENDMENTS
A.The following shall be added under para
2(ii):
While effecting transfers in both the cases
(i) & (ii) above.
a) preference be given in spouse cases (Only one of the spouse shall be shifted)
b)
Similarly,
the standing instructions on the transfers of Office Bearers of recognized employees unions as issued in Circular Memo
No.26135/Ser. Welfare/2002-1 of G.A. (Services) Department, dt.19.6.2002 be followed.
c)
Preference in place of posting at the time of transfer/promotion, either to
continue in the same place or to post them
as per their request, be given
to the persons with disability/physically challenged persons*subject
to the
administrative constraints.
d) Preference be given in place of posting to the employees, having
mentally
retarded children to a place where medical facilities are available.
*Note: 40% or more as
certified by a competent authority as per “Persons with Disabilities (PWD)
(Equal opportunities, protection of rights and full participation) Act,1955,
B. The following shall be substituted to para
2(iv):
The transfers of Teachers/Non-Gazetted staff be
done by counseling. Further in this category not more than 20% of employees
working in that cadre be transferred.
C. The date of “30th
September, 2014” occurring in para 2(v) shall be substituted
D.
The date “1st October, 2014” occurring
in para 2(vii) shall be substituted with “11th
October, 2014”.
E.
The
following shall be added after para 2 (vii):
Separate
guidelines be issued, required if any, by the Revenue earning Departments
viz. C&T, Excise, Stamps &
Registration Departments, Transport and Forest Department, to suit their
specific requirements in consonance with the above guidelines.
3. All
the Departments of Secretariat and Heads of Departments have to follow the
above orders scrupulously.
