Representation submitted in the 2nd GB to the Chief Guest.




MEMORANDUM SUBMITTED TO HONORABLE SMT. SUNITHA LAXMA  REDDY garu, THE MINISTER FOR WDCW&DW ON 05/06/2011

Respected madam,

            The disabled persons constitute weakest among the weaker sections and times immemorial, they are being discriminated and denied of their due share of opportunities. They are about 7% of the total population. They can not live without the assistance of some body in day to day life. The following are certain problems, which need the attention and immediate solution from the Government and the society.

  1. RESERVATION IN PROMOTIONS:- The Government of India is implementing the rule of reservation in promotions besides direct recruitment to the disabled employees. The Government of A.P is also implementing Rule of reservation in direct recruitment up to Group I Services, but not in promotions. Further the SCs and STs are also given reservation in promotions. The Government was pleased to assure the Honorable House of the State Assembly that it is considering the reservation in promotions to the disabled employees on 9/12/2004.

Therefore we request you kindly to interfere in the matter and issue suitable orders for implementation of Rule of Reservation in promotions to the disabled employees in all categories posts for which they are suitable, on par with the Government of India and SC and ST employees in the state without any restrictions.

  1. RELAXATION IN TRANSFERS AND POSTINGS:- The disabled persons are generally dependents on somebody in their day to day life. Without the help of their spouse, relatives, and friends it is very difficult to stay in different places. The Government of India and the Banking Sector etc have evolved a separate transfer policy for transfers and postings of the disabled employees in their convenient places under the provisions of the PwD Act 1995.
                 In view of the above we request you kindly to issue suitable orders framing a transfer policy 
          for retention/posting of the disabled

employees/teachers with 40% and above disability in their convenient places duly relaxing all the restrictions such as period of two/eight years of stay at one place, and Native Mandal/Native Districts where it is convenient to such disabled employee.

  1. WEIGHTAGE TO GET FULL PENSION :-  The Government of A.P have been kind enough to give 10 years of age relaxation in recruitments to the disabled persons in view of their late brought up due to deformity. Persons appointed with age relaxation are not getting full pension and they are allowed pension proportionately with reference to their service only. In fact there will be a strain on the finances of the disabled and they will have to face much hardship after their retirement.
Therefore we request you kindly to issue suitable orders to allow the pension to the disabled employees on the lines of enhanced family pension i.e. 50% of the pay last drawn, to enable them to get full pension on their retirement.

  1. EXTENDING OF PENSION TO  DISABLED EMPLOYEES APPOINTED FROM 01/09/2004: The employees with disabilities appointed on or after 01/09/2004 are not provided with the pension under APLPR 1980 and brought under CPS along with normal employees, which is becoming burden on the disabled employees, which is not there to the employees appointed prior to 01/09/2004, and causing finical hardship and strain. The disabled employees will have to face much difficulty and insecure after their retirement in the absence of regular source of income ie pension.
Therefore we request you kindly to extend the A.P. Liberalized Pension Rules 1980  to the employees with disability, appointed on or after 01/09/2004.

  1. INSURANCE SHCEME TO THE DISABLED EMPLOYEES:- As per the Art.67 of the PWD Act, the Govt. have to frame an Insurance Scheme and instead of framing Insurance scheme an alternative Security Scheme may be framed for its disabled employees. Whereas this provision is not implemented even after lapse of 16 years.
We therefore request you kindly, to issue suitable orders for framing a Security Scheme or an Insurance Scheme for disabled employees as insurance companies are not extending full insurance coverage to the disabled persons.

  1. ALLOTMENT OF HOUSE SITES:-  The Government is allotting house sites to all the state government employees and the house sites were handed over to the Services Associations. It is not known how many sites were allotted to the disabled employees and whether the reservation is followed in allotment of the house sites in respect of the disabled employees.
Therefore we request you kindly to allot 3% of house sites in the house sites allotted to the service associations, to the disabled employees on par with other employees.

  1. PERMISSION TO USE OWN/HIRED VEHICLE IN LTC/TA:-  We submit that the government of India have been pleased to relax LTC rules to allow use of own / hired taxi for LTC journey on account of disability of the govt. servant or dependent family, as the physically disabled or dependent of family members are unable to perform the LTC journey by the authorized modes of transport and are compelled to undertake the journey by own car or private taxi vide Govt. of India OM F. no. 31011/3/2009-Estt.(A) Dated. 28/10/2009 of Ministry of Personnel, Public Grievances & Pension Department of Personnel & Training.
In this regard we submit that the physically disabled employees, working in Govt. of Andhra Pradesh are also facing the same problem in performing LTC journey and other journeys on official tour/ Transfers etc.
In view of the above we request you kindly to issue necessary relaxations to the LTC rules to perform the journey by own motor car or by a private taxi and allow mileage allowance and amend the APTA and LTC Rules suitably in respect of disabled employees and their dependent family members.

  1. TRANSPORT ALLOWANCE IN PLACE OF CONVEYANCE ALLOWANCE:- The Government is pleased to pay conveyance allowance at 10% of the basic pay or Rs.900/- whichever is less to the state Government disabled employees. It is submitted that the cost of living and the prices have gone up and transportation has became a burden on the disabled employees.
We therefore request you kindly to enhance the ceiling of Rs 900/- to Rs.3000/- OR replace the transport Allowance in the place of Conveyance Allowance on the lines of Govt. of India.

  1. BARRIER FREE ENVIRONMENT IN THE OFFICES: We submit that the disabled employees are put to hardship in attending their duties lack of barrier free environment as provided in P w D Act 1995.
We request you kindly to issue orders to provide barrier free environment in all the offices.
  1. ENHANCEMENT OF READERS ALLOWANCE:  The teachers with visual impairment are being paid very meager amount of readers allowance so as to access to the latest trends in fields of education and academic books so as to impart such knowledge to the students. The readers allowance now paid is very meager and no reader is accepting for the amount now allowed due to increase in cost of living. Further it is not being paid during holidays.
We therefore request you kindly enhance the readers allowance to Rs. 2000/ pm, on the lines of Government of India.
           
  1. DEPUTATION FACILITY FOR ACQUIRING FURTHER QUALIFICATIONS: The government is allowing On Duty ( Deputation) facility to the SC and ST employees for acquiring additional qualifications during the employment because of their late brought up and backwardness. The disabled persons are also facing the same problem of late brought up due the deformity.
We therefore request you kindly to extend the OD facility to the employees with disabilities on par with the SC and ST employees.

  1. REGULARISATION OF SERVICES OF APVCC EMPLOYEES: The APVCC employees are treated inhumanly by reducing their salaries against the natural justice in the name of irregular appointments. Employee is not responsible for irregular appointment if any. They are suffering from half bread and their children are not given proper education due to less salary. Many of them have lost their lives for want proper medical assistance and the above given financial crunch due to fewer salaries.
We request you kindly to consider the following suggestions: 
  1. Pay the enhanced salary as per the PRC 2010 to all the employees.
  2. To continue the surplus staff, if any, on rolls of APVCC by deciding Cadre Strength (or)
  3. To accommodate them on redeployment in any other government department or it’s under takings.
We request you kindly to issue suitable early orders on the above problems, for which act of kindness we shall be ever grateful and thankful to you, madam.
